South Sudanese Citizen Files Lawsuit Against Republic of South Sudan for Illegal Detention of Former Mayor

In a bold move to seek justice and protect human rights, a South Sudanese citizen, Ann-Grace Juan Fiorentino Loro, has taken legal action against the Republic of South Sudan for the illegal detention of former Mayor Kalisto Ladu. Loro’s legal representatives, M/S PAN AFRICAN LAW CHAMBERS, LLP, have issued a demand notice cum notice of intention to sue, citing grave violations of constitutional and fundamental rights.
The notice outlines the shocking circumstances of Ladu’s abduction by National Security Service (NSS) agents, his inhumane treatment, and subsequent incommunicado detention at the NSS detention center. The legal team argues that such actions blatantly disregard the rule of law, constitutional protections, and international human rights standards.
Furthermore, the notice warns of potential legal action at the East African Court of Justice (EACJ) if the Republic of South Sudan fails to comply with demands for the immediate release of Kalisto Ladu. The legal representatives emphasize the urgency of the situation, highlighting Ladu’s deteriorating health and the need for urgent medical attention.
The arrest and subsequent detention of former Juba City Council Mayor Kalisto Ladu on 30th March have drawn widespread condemnation from various quarters, including the Embassy of the United States of America in Juba, South Sudan. The lack of transparency, due process, and the alarming circumstances surrounding Ladu’s arrest have raised concerns among human rights groups, civil society organizations, and political entities.
Kalisto’s wife, Joana Andrea, provided harrowing details of the night when armed men, both in uniform and plain clothes, forcibly took her husband from their home late at night. The arbitrary nature of the arrest, coupled with the absence of a clear explanation for the detention, has sparked outrage and calls for immediate action to ensure Ladu’s safety and well-being.
In response to mounting pressure and public outcry, the U.S. Embassy in Juba issued a statement condemning the arrest of Kalisto Ladu and expressing solidarity with those demanding justice and respect for human rights. The Embassy’s stance aligns with the sentiments echoed by numerous human rights defenders, civil society actors, and concerned individuals who have called for accountability and adherence to the rule of law.
However, conflicting reports have emerged regarding Ladu’s status, with the police spokesperson claiming that he has been released. Kalisto’s wife, Joana Andrea, vehemently denies this assertion, stating that her husband’s whereabouts remain unknown, raising further questions about his safety and the validity of official statements.
The legal challenge serves as a critical reminder of the importance of upholding the rights and freedoms of all individuals, regardless of their status or position. The outcome of this case could have significant implications for the protection of human rights in South Sudan and beyond.
