Juba County Court bans BMC Garden, a popular entertainment venue, from hosting events

BMC Garden, a beloved entertainment venue, has been prohibited from hosting events by the Juba County Court. 

The ruling came after a case was filed by lawyer Kiir Chol Deng Acuil on behalf of concerned residents of Nyakuron, who blamed BMC Hall’s management for noise pollution. 

The court has issued a permanent injunction, forbidding any wedding activities at the venue. While Chol expressed disappointment that the court did not impose jail time, he highlighted that the hall lacked a license from the Juba City Council, which was overruled by the Juba County Court. 

The presiding judge, Nyang Wol, ordered the owner of BMC Hall, Bol Mawut Deng, to cease hosting wedding occasions at the BMC gardens starting from December 12, 2023. The loud music played at the venue was found to violate order No.3 2023, issued by the Juba City Council, which prohibits operating music in residential areas. 

The court ruling is in accordance with Section 177 of the 2008 Penal Code Act, which defines public nuisance as an act or omission causing injury, danger, or annoyance to the public. 

Additionally, the 2013 Juba City Council bylaws, amended in 2020, state that nightclubs and disco places must operate in approved locations, obtain licenses and operation certificates from the relevant authorities.
